Terms of Service

By accessing or using the WSAPI platform ("Service"), including our website, API, cloud hosting, and related tools, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

WSAPI provides an open-source WhatsApp API with optional managed cloud hosting. The Service allows users to send and receive WhatsApp messages programmatically through a RESTful API. We offer both a free, self-hosted community edition and paid cloud-hosted plans.

To use certain features of the Service, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information when creating your account.

You must be at least 18 years old to create an account and use the Service.

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Send unsolicited messages (spam), including bulk commercial messages
• Harass, threaten, or abuse other individuals
• Distribute malware, viruses, or other harmful software
• Impersonate any person or entity, or falsely represent your affiliation with any person or entity
• Interfere with or disrupt the integrity or performance of the Service
• Attempt to gain unauthorized access to the Service or related systems
• Violate WhatsApp's Terms of Service or any applicable third-party terms

We reserve the right to suspend or terminate your account if we determine, in our sole discretion, that you have violated these Terms.

Paid plans are billed on a monthly or annual basis depending on your selection. All fees are non-refundable except as required by law. Prices may change with 30 days advance notice.

Free trials are available for new users. At the end of a trial period, your instance will be paused unless you subscribe to a paid plan.

You may cancel your subscription at any time through your account dashboard. Cancellation takes effect at the end of the current billing period. You will retain access to the Service until the end of the period you have already paid for.

Use of the WSAPI API is subject to rate limits and fair use policies. Excessive or abusive API usage may result in temporary throttling or account suspension. We reserve the right to modify rate limits at any time.

The WSAPI open-source software is released under its respective open-source license. All other content, including but not limited to the website design, documentation, logos, and trademarks, are the property of WSAPI and are protected by intellectual property laws.

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of information as described in the Privacy Policy.

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, secure, or error-free. We are not responsible for any delays, delivery failures, or other damages resulting from use of the Service.

To the maximum extent permitted by law, WSAPI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to your use of the Service.

Our total liability for any claims arising under these Terms shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

The Service integrates with WhatsApp, which is a product of Meta Platforms, Inc. WSAPI is not affiliated with, endorsed by, or sponsored by Meta or WhatsApp. Your use of WhatsApp through WSAPI is subject to WhatsApp's own Terms of Service.

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

These Terms are governed by and construed in accordance with applicable law, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved through binding arbitration.
